My coworker said Delaware PIP covers e-bike crashes too, is that true?

What the insurance company does not want you to know about this is that Delaware's no-fault PIP system can apply even if you were not in a car. If you were riding an e-bike in Middletown and a motor vehicle hit you, there is a strong chance Personal Injury Protection (PIP) coverage is available for medical bills and lost wages, regardless of who caused the crash.

The key limit is this: PIP usually applies because of the car or truck involved, not because the e-bike itself carries coverage. In Delaware, auto policies must include at least $15,000 per person and $30,000 per accident in PIP under 21 Del. C. § 2118. If an insured vehicle struck you on roads like US-13 or near Middletown's busier connectors during spring pothole season, that coverage may pay first. That surprises people who moved from states without Delaware's mandatory PIP rules.

To prove it, gather the documents that tie your e-bike crash to an insured motor vehicle and to your injuries:

  • The police crash report from the responding agency
  • The driver's insurance information
  • Photos of the scene, vehicle, e-bike, potholes, debris, and damage
  • Your ER, ambulance, imaging, and follow-up records
  • Proof of lost wages or missed work, if any
  • The e-bike purchase information or manual showing it fits Delaware's e-bike classification
  • Names of witnesses and any nearby camera footage

If the crash involved a pothole, frost-heaved shoulder, or broken pavement in the Middletown area, keep separate proof of that too, because a road-defect claim is different from a PIP claim. For the road side of it, photos taken immediately, repair estimates, and any notice history with DelDOT matter. PIP, though, is about getting those initial medical bills paid without waiting for fault to be sorted out.
